The plaintiffs appealed to the German Attorney General’s Office and the Berlin Public Prosecutor’s Office, accusing Merz of violating Article 80a of the German Criminal Code (“Incitement to aggression”). The Chancellor’s phrase “This is the dirty work that Israel does for all of us” caused particular complaints.
According to the applicants, this expression refers to Nazi rhetoric – similar formulations were used to justify the mass executions at Babi Yar in 1942.

Critics also dispute Merz’s claims that Iran’s nuclear bomb was thwarted, citing US intelligence evidence that allegedly refutes the information. They point out that similar claims have been made by Israeli leaders for more than 20 years.
